Buying an apartment in Croatia, what you have to know

When buying an apartment in Croatia the situation is similar to buying a house or any other Croatia Property. However, the main thing to look for is the Division Document. When an apartment building is constructed it's initially registered in the Land Registry in Croatia as a single building.

Once the roof is on the developer can apply for the block to be legally divided. Once this has been done, each apartment in Croatia assumes a legal life of its own. This is important, as until it is done, all that is on offer is a share of the building. If there are 12 apartments in Croatia, you will own a twelfth of your apartment in Croatia and a twelfth of everyone else's and they will own the same of yours. This is very undesirable, as you would need all of them to sign whenever you wanted to do anything. Once the Division Document is done, however, you would have a specific apartment in Croatia.

Otherwise, the documentation will be the same as for any other new Croatia property and you will want to see the Certificate of Title, Building Permit and a Usage Certificate. Be aware that if the building is still being completed, or has only recently been completed, the Certificate of Title and the Usage Certificate will not be available immediately, but they can be incorporated into the final contract of the Croatia property.

Buying property in Croatia to let is no different. If you are going to let the property out, this should be through the medium of a Croatian company. Whether it is your company or that of a local letting agent does not really matter. It is not essential to set up your own company, so long as at least some Croatian company is involved.
